Welcome to Merrylaine. These Terms & Conditions govern your use of Merrylaine.com, purchases made through our website, and participation in our Memory Collection services.

By accessing our website, placing an order, or submitting content to Merrylaine, you agree to these Terms & Conditions.

1. About Merrylaine

Merrylaine is a Maryland-based Christmas keepsake and décor business specializing in handcrafted ornaments, personalized gifts, and memory-preserving products.

Our Memory Collection combines physical keepsakes with digital technology, allowing customers to preserve photographs, stories, voices, and videos through personalized Memory Pages.

2. Products & Availability

• All products are subject to availability.
• Product descriptions, photographs, measurements, and prices are provided as accurately as reasonably possible.
• Handcrafted products may have slight variations in wood grain, engraving, color, and finish.
• Natural material variations are not defects unless they materially affect quality or function.
• Merrylaine may discontinue products or correct pricing and description errors.
• If an error affects an existing order, Merrylaine will contact the customer about available options, including cancellation and a refund where appropriate.

3. Orders & Payments

• Orders must be placed through Merrylaine.com or an authorized Merrylaine sales channel.
• Payment is required before production unless otherwise agreed in writing.
• Customers must provide accurate billing, shipping, and contact information.
• An order confirmation acknowledges receipt but does not guarantee acceptance or fulfillment.
• Merrylaine may cancel orders involving suspected fraud, unavailable products, or significant pricing errors.
• If Merrylaine cancels a paid order, the customer will receive a refund for canceled items.

4. Personalized & Handcrafted Products

Certain products use customer-provided photographs, names, dates, messages, or other personal details.

• Customers are responsible for reviewing personalization information for accuracy.
• Photographs must be suitable for engraving or reproduction.
• Merrylaine may request clarification or replacement materials when needed.
• Minor differences between digital previews and finished products may occur.
• Production begins after payment and all required personalization information are received.
• Changes requested after production begins may not be possible and may result in additional charges.

5. Memory Collection Submission Requirements

Customers purchasing Memory Collection ornaments must complete the appropriate Memory Submission Form after checkout.

Classic Memory Ornament
• Complete the Classic Memory Submission Form.
• Merrylaine selects the engraved ornament design.
• Customers provide the information and media for their digital Memory Page.

Personalized Memory Ornament
• Complete the Personalized Memory Submission Form.
• Provide the chosen engraving photograph and digital Memory Page content.

Memory Light™ Ornament
• Complete the Personalized Memory Submission Form.
• Provide the chosen engraving photograph and premium Memory Page content.
• The Memory Light™ includes illumination and expanded digital Memory Page features.

Important Conditions
• Include the order number and associated email address when submitting memories.
• Production cannot begin until the required information is received.
• Delayed submissions may delay production and shipping.
• Merrylaine may request clarification or replacement materials when necessary.

6. Digital Memory Page Features & Limits

Memory Collection ornaments include access to a digital Memory Page through NFC technology.

Classic Memory Ornament
• Up to 10 photographs
• Up to 2 audio recordings
• Up to 1 video
• Standard Memory Page design
• 2 years of included hosting

Personalized Memory Ornament
• Up to 10 photographs
• Up to 2 audio recordings
• Up to 1 video
• Standard Memory Page design
• 2 years of included hosting

Memory Light™ Ornament
• Up to 30 photographs
• Up to 5 audio recordings
• Up to 3 videos
• Personalized Memory Page customization
• 2 years of included hosting

Media submissions must meet applicable limits and any file-size or technical requirements communicated by Merrylaine.

7. Memory Page Hosting & Continued Access

• Each Memory Collection ornament includes 2 years of digital Memory Page hosting.
• The hosting period begins when the completed Memory Page becomes available.
• Merrylaine intends to continue providing access while the business remains operational, subject to service availability and these terms.
• Continued hosting beyond the included period is not guaranteed unless covered by an active hosting agreement or membership.
• Additional hosting options or memberships may be offered at prices disclosed before purchase.
• Future hosting plans or pricing may change with appropriate notice, without reducing an already purchased hosting period.
• Customers should retain original copies of all submitted content.
• Merrylaine does not guarantee permanent or lifetime storage of digital content.

8. NFC Technology & Device Compatibility

Memory Collection ornaments use Near Field Communication (NFC) technology to connect compatible devices to a digital Memory Page.

• Customers need an NFC-compatible smartphone or supported device and an internet connection.
• NFC performance may vary by device, operating system, settings, protective case, and network availability.
• Merrylaine cannot guarantee compatibility with every device.
• Device updates, internet outages, or technical changes may affect access.
• Contact Merrylaine if an ornament’s NFC function is defective upon delivery.

9. Customer Content & Permissions

Customers retain ownership of the original content they submit, subject to third-party rights.

By submitting photographs, videos, recordings, written stories, or other materials, customers:
• Confirm they own the content or have permission to submit it.
• Confirm they have permission from people whose images, voices, or personal information are included.
• Grant Merrylaine a nonexclusive, royalty-free license to store, process, reproduce, edit for formatting, and display the content as reasonably necessary to fulfill the order and provide Memory Page services.
• Agree not to submit unlawful, infringing, threatening, or prohibited content.
• Acknowledge that Merrylaine may decline or request replacement content that violates these terms.

Merrylaine will not use customer-submitted personal memories in public advertising or promotional materials without separate permission.

10. Memory Page Privacy & Sharing

Digital Memory Pages may contain personal photographs, names, stories, voices, and videos.

• Memory Pages may be accessible to anyone with the page link or who scans the ornament’s NFC tag.
• Customers should not assume Memory Pages are private or password-protected.
• Customers are responsible for considering the privacy of people featured in submitted materials.
• Do not submit confidential financial information, government identification numbers, passwords, or other highly sensitive information.
• Additional privacy or access controls may be offered in the future but are not guaranteed unless included in the purchased service.

Personal information is otherwise handled under Merrylaine’s Privacy Policy.

11. Digital Content Storage & Service Interruptions

Merrylaine takes reasonable measures to maintain its digital services. However:

• Temporary interruptions may occur because of maintenance, hosting issues, internet outages, security incidents, or third-party disruptions.
• Merrylaine cannot guarantee uninterrupted access or that digital content will never be lost.
• Customers should maintain personal backups of submitted materials.
• Merrylaine will make reasonable efforts to restore access when feasible.
• Customers may contact Merrylaine for help with an inaccessible Memory Page.

12. Shipping & Delivery

• Shipping estimates are for convenience and are not guaranteed delivery dates unless expressly stated.
• Personalized products may require additional production time.
• Shipping costs and applicable taxes appear during checkout.
• Customers are responsible for accurate delivery addresses.
• Merrylaine is not responsible for carrier delays, severe weather, or events outside its reasonable control.
• Report lost, damaged, or misdelivered shipments promptly so Merrylaine can review available remedies.

13. Returns, Cancellations & Refunds

Because some products are personalized or made to order, return eligibility may vary.

• Non-personalized products may be eligible for returns under Merrylaine’s published Return & Refund Policy.
• Personalized products generally cannot be returned solely because of a change of mind after production begins.
• Contact Merrylaine promptly to request cancellation or changes.
• Damaged, defective, incorrect, or materially misrepresented products will be reviewed for an appropriate remedy, including replacement, repair, or refund where required.
• Nothing in these terms limits rights or remedies that cannot legally be excluded.

14. Intellectual Property

Merrylaine’s original product designs, branding, website content, photographs, graphics, and other creative materials are protected by applicable intellectual property laws.

• Customers may not reproduce, distribute, or commercially exploit Merrylaine’s original designs or website content without authorization.
• Purchasing an ornament does not transfer ownership of Merrylaine’s underlying designs or intellectual property.
• Customers retain applicable rights in original materials they submit.
• Merrylaine’s use of customer content is governed by Section 9.

15. Website Use

Customers agree not to:
• Use Merrylaine.com for unlawful or fraudulent activities.
• Access another customer’s order or private information without authorization.
• Interfere with website functionality or security.
• Upload malicious files or harmful software.
• Misrepresent ownership of submitted materials.

Merrylaine may restrict access or refuse services when reasonably necessary to address violations, subject to applicable law.

16. Limitation of Liability

To the extent permitted by law, Merrylaine is not responsible for indirect, incidental, special, or consequential losses arising from website use, service interruptions, or product use.

Nothing in these terms excludes liability or consumer rights that cannot lawfully be limited.

17. Changes to These Terms

Merrylaine may update these Terms & Conditions to reflect changes in products, services, technology, or legal requirements.
